Note on the governing language: These Terms of Service are originally drafted in German. This English version is provided for informational purposes only. In the event of any discrepancy or interpretation issue, the German version shall prevail (see § 1 paragraph 4).


§ 1 Scope and Contracting Parties

(1) These Terms of Service (hereinafter "Terms" or "Terms of Use") govern the contractual relationship between you (hereinafter "User" or "you") and

(hereinafter "FrontByte" or "we") regarding the use of the mobile application "SafePing" and the associated web services (collectively, the "Service").

(2) The Service is made available via the Apple App Store and the Google Play Store as a native application for iOS and Android, as well as via the website safeping.net.

(3) These Terms apply to all Users worldwide, unless mandatory national provisions stipulate otherwise. Any supplementary or deviating terms of the User shall not become part of the contract unless FrontByte expressly agrees to their applicability in writing.

(4) The German language version of these Terms is the legally binding version. Translations into other languages are provided for informational purposes only. In the event of any discrepancy, the German version shall prevail.

(5) These Terms enter into force on 1 May 2026 and replace any previous versions.


§ 2 Description of the Service

(1) SafePing is offered in two access modes:

a) "SafePing Free" (also referred to as "Free Mode") – free basic access without a subscription. Available features include the display of worldwide emergency phone numbers (police, fire department, ambulance) based on the country of stay determined via GPS. Tapping a number opens the device's system phone dialer; the App itself does not place calls. In addition, the international emergency number 112 is always shown as a default.

b) "SafePing Pro" – paid protection service requiring an active subscription pursuant to § 7. Pro includes all features of Free, plus the protection features described in paragraphs 2 to 7 below.

(2) SafePing Pro operates on the principle of a "Dead Man's Switch". The App periodically captures the User's location and transmits it to FrontByte's servers (hereinafter "Check-Ins" or "Pings"). By default, transmission occurs every 28 minutes, where technically possible.

(3) The User may select an alert threshold of 12, 24, 48 or 72 hours. FrontByte reserves the right to adjust ping intervals and available alert thresholds for technical or security-related reasons. Material changes will be communicated to the User in good time within the App.

(4) If FrontByte does not receive a Check-In within the selected alert threshold, the User is prompted to confirm their safety via push notification and email 30 minutes prior to the threshold's expiry ("Pre-Alert"). If no response is received within those 30 minutes, the stored emergency contacts are automatically notified by SMS. The alert SMS contains the User's first name, a link to a protected detail page showing the last known location, and the PIN required to access this page.

(5) In addition, the User may trigger an alert manually at any time via the "SOS" button in the App (activation by holding the button for three seconds). In the case of an alert triggered by mistake, the User can issue an "all clear"; the emergency contacts will then immediately receive a corresponding SMS notification.

(6) The User may register a minimum of one (1) and a maximum of five (5) emergency contacts. Emergency contacts will only be notified in the event of an alert. Before activation, they must actively confirm their role via a confirmation link sent to them (double opt-in); details are set out in § 6.

(7) With the "Home Mode" function (pause mode), the User can deactivate Check-In monitoring within their home country as defined in their profile. While in pause mode, no Check-Ins are transmitted and no inactivity alerts are triggered. If the User leaves their home country (as detected via GPS), monitoring is automatically reactivated. Manual pausing while abroad is not possible. The SOS button remains available even in pause mode.

(8) SafePing stores per User exclusively the data required for operating the Service: account data (name, email address, phone number, device token), SafePing settings, the registered emergency contacts, and a maximum of the last three (3) transmitted location positions for use in the event of an alert. Older location data is automatically and irrevocably deleted. No movement profile and no location history is created. Further details on data processing and engaged data processors can be found in the Privacy Policy.

(9) Use of the Service requires a compatible end device and an active internet connection. For the proper operation of SafePing Pro, the following permissions must be granted by the User:

Mandatory for the core function:

a) Access to location, including in the background ("Always" / "Allow all the time"); b) Permission for background execution of the App.

Recommended for full functionality:

c) Reception of push notifications. Without this permission, the Check-In function remains active, but security-relevant notifications such as the Pre-Alert cannot be delivered.

If mandatory permissions are revoked, restricted by the operating system (e.g. through power-saving modes, background or battery optimizations) or blocked or restricted by security-related software on the device (e.g. antivirus, anti-tracking, firewall or comparable protection applications), or if the device is switched off, defective, out of range of a mobile network or otherwise non-functional, FrontByte cannot guarantee the proper operation of the Service. In such cases, Check-Ins, Pre-Alerts or notifications to emergency contacts may fail, be delayed or be incomplete, so that the intended protection in emergency situations may not take effect, or only partially. FrontByte assumes no liability for any damages arising therefrom – including indirect damages, consequential damages, personal injury or financial losses – to the extent permitted by law. The liability provisions of § 11 apply in addition. Details on the technical minimum requirements can be found in the App description in the respective App Store.

(10) FrontByte assumes no warranty for the accuracy, completeness or accessibility of the displayed emergency numbers. In an emergency, the official emergency number applicable in the respective country must be dialed.


§ 3 Conclusion of Contract and Account

(1) The use of SafePing requires the creation of a user account (hereinafter "Account"). Registration is conducted exclusively via the SafePing mobile App. Registration via the safeping.net website is not provided.

(2) SafePing uses a passwordless authentication procedure. During registration, the User provides the following data:

a) Mobile phone number, which is verified by means of a one-time code (OTP) sent via SMS; b) Name (freely chosen); c) Email address, which is verified by means of a one-time code (OTP) sent via email.

Registration via third-party logins ("social login") or with a traditional password is not offered.

(3) The contract for the free use of SafePing Free pursuant to § 2 paragraph 1 lit. a is concluded upon successful verification of both one-time codes. The paid protection service "SafePing Pro" is activated by entering into a subscription pursuant to § 7.

(4) Only one Account is permitted per person. By registering, the User affirms that the data provided is truthful, complete and current. Changes to security-relevant data – in particular phone number, email address and registered emergency contacts – must be updated in the Account without undue delay. Outdated or incorrect data may result in the protection service not functioning properly; the responsibility for this lies with the User.

(5) After successful registration, the User remains permanently logged in on the registered device; renewed authentication during ongoing use is not provided. The User is obliged to protect access to the mobile phone used during registration. In the event of loss, theft or suspected unauthorized access, the User must inform FrontByte without undue delay and have access blocked.

(6) In the case of a device change, device defect or loss of the end device, the User can reactivate their Account on a new device via a recovery procedure ("Recovery Mode"). To this end, the User provides the phone number registered during sign-up and verifies it again via SMS one-time code (OTP). After successful verification, the Account – including emergency contacts and settings – is transferred to the new device. Recovery without access to the registered phone number is technically not possible.

(7) The Account is personal and non-transferable. Shared use by multiple persons is excluded.

(8) FrontByte is entitled to suspend or delete an Account if:

a) the User materially violates the provisions of these Terms; b) the User has provided false identity information; c) the Account is being used for unlawful purposes or in a manner that endangers or harasses other persons (in particular unauthorized registration of third parties as emergency contacts).

Prior to suspension or deletion, the User will generally be warned and invited to comment, to the extent reasonable given the nature and severity of the violation. In the case of permanent payment default, the Account reverts to Free Mode pursuant to § 7; no Account suspension occurs for this reason.


§ 4 Use by Minors

(1) SafePing does not define a technical minimum age for installation and use of the App. The protection function of the Service can in principle benefit persons of any age.

(2) However, conclusion of the user agreement with FrontByte pursuant to § 3 requires full legal capacity. Minors may only enter into the contract with the express consent of their legal guardian (parent or guardian). By registering, the User confirms that this consent – where required – has been given.

(3) For the processing of personal data of children under the age of sixteen (16) pursuant to Art. 8 GDPR, the express consent of the legal guardian to the data processing is additionally required. By registering on behalf of or for a child under 16 years of age, the legal guardian confirms that they consent to this data processing and have taken note of the processing purposes described in the Privacy Policy.

(4) Entering into a paid subscription pursuant to § 7 is conducted exclusively via the Apple App Store or the Google Play Store. The respective platforms' requirements for payment methods, family sharing and approvals of purchases by minors (e.g. Apple "Family Sharing" / "Ask to Buy", Google "Family Link") apply additionally and lie outside FrontByte's sphere of influence. Parents and legal guardians are responsible for configuring their account settings and the linked devices of their children in such a way that no unwanted purchases can be made.

(5) Legal guardians are obliged to supervise the use of the App by their minor children. They are particularly responsible for ensuring that:

a) the registered emergency contacts are actually suitable and consenting persons (cf. § 6); b) the location sharing and background use of the App are age-appropriate; c) the use of the App complies with local statutory provisions on youth protection.

(6) If FrontByte becomes aware that an Account has been created without the consent required under paragraph 2 or 3, FrontByte is entitled to suspend or delete the Account. Personal data already collected will in this case be deleted without undue delay, unless statutory retention obligations apply.


§ 5 Duties and Responsibilities of the User

(1) SafePing is a technical aid and not a rescue service. In particular, the protection functions of SafePing Pro can only take effect if the User fulfills the duties set out below. The User bears responsibility for the consequences of any breach of these duties.

(2) The User is obliged to:

a) provide truthful, complete and current data during registration and ongoing use, in particular a reachable phone number, a valid email address and correct emergency contact details;

b) select an alert threshold appropriate to their living circumstances, travel plans and activities, and adjust it as needed;

c) keep the permissions required for the operation of the App as set out in § 2 paragraph 9 permanently granted, and not revoke them as long as they wish to use the SafePing Pro protection service;

d) keep the App and the operating system of the end device up to date. In particular, the User is obliged to install App updates provided by FrontByte without undue delay as soon as they become available or are displayed. The User is additionally informed of available updates via push notification and via the App Store update indicator (badge counter on the App icon). Security- and function-critical updates ("Mandatory Updates") must be installed within seven (7) days of becoming available; without installation, FrontByte may restrict or suspend the protection service for security reasons until the current version is installed;

e) ensure sufficient battery charge of the end device and, during travel or activities prone to risk, keep the device charged and operational as far as possible;

f) regularly check the functionality of the Service, in particular before commencing a trip or an activity for which they wish to rely on SafePing Pro;

g) deactivate operating-system power-saving, background or battery-optimization restrictions, as well as blocking settings of security-relevant software (e.g. antivirus, anti-tracking or firewall applications) for SafePing, or exempt the App from such restrictions;

h) not use the Service for unlawful, abusive or harassing purposes, in particular not deliberately trigger false alarms.

(3) The User acknowledges and accepts that SafePing does not replace and does not automatically trigger an emergency call to official rescue services (police, fire department, ambulance). Likewise, the display of worldwide emergency numbers in SafePing Free serves only as an aid; calls are placed via the device's system phone dialer. In acute emergencies, the official emergency number of the country of stay must always be dialed without delay (cf. § 12). The User is responsible – to the extent possible – for transmitting to rescue forces directly the information required for effective assistance, in particular their own location, the type of emergency and details of affected persons. SafePing cannot replace this direct communication with rescue forces.

(4) SafePing must not be used as the sole safety measure. In particular, for high-risk activities (e.g. alpine tours, dives, travel to crisis areas), supplementary safety precautions must be taken.

(5) Before registering a person as an emergency contact, the User is obliged to obtain their consent and to ensure that this person is willing and suitable to respond in the event of an alert. Details on the confirmation procedure (double opt-in) are set out in § 6.

(6) The User bears all costs incurred through use of the Service on their end device, in particular costs for mobile communications, data transmission, roaming and outgoing calls to emergency numbers placed directly from the App.

(7) A breach of the obligations set out in this paragraph may result in the suspension or deletion of the Account pursuant to § 3 paragraph 8 and releases FrontByte from liability for any resulting protection failure, to the extent permitted by law.


§ 6 Emergency Contacts

(1) Emergency contacts are the persons registered by the User who, in the event of an alert (cf. § 2 paragraphs 4 and 5), are notified by SMS in order to organize help for the User. The management of emergency contacts – in particular adding, editing and removing – is possible exclusively with an active SafePing Pro subscription and is not available in Free Mode. The User may register a minimum of one (1) and a maximum of five (5) emergency contacts.

(2) Before registering a person as an emergency contact, the User is obliged to obtain that person's express consent. By registering them, the User affirms that this consent exists and that they are entitled to transmit the phone number of that person to FrontByte for the purpose of alerting.

(3) To safeguard this consent, every emergency contact registered for the first time is activated through a two-step confirmation procedure ("double opt-in"):

a) The emergency contact receives a confirmation request containing a personal confirmation link ("magic link"). Delivery is made – in this order – via an in-app notification with push, provided the contact is themselves a SafePing user with push notifications enabled, otherwise by SMS from the service number +41 75 573 22 66 or sender ID «SAFEPING»;

b) Via the confirmation link, the emergency contact is taken to a protected web page showing the name of the inviting User, the consequences of confirmation, and the option to decline. The contact is only unlocked as a valid emergency contact and will receive notifications in the event of an alert after active confirmation via this web page;

c) If no confirmation is received, the contact declines, or the confirmation link expires without response (default: seven days), they remain inactive and will not be notified in the event of an alert.

The confirmation request is sent only when a SafePing Pro subscription is concluded for the first time, and only for contacts not yet confirmed. Already-confirmed contacts remain permanently active and will not be asked to confirm again upon a later resubscribe.

The service number +41 75 573 22 66 is used exclusively for the confirmation procedure as well as for alert and stand-down SMS; it is not a reply or support number.

(4) In the event of an alert, the emergency contact receives an SMS containing the following information:

a) the User's first name; b) a link to a protected detail page with the User's last known location; c) a PIN to access the detail page; d) references to the international emergency number 112 as well as recommended actions.

In the case of an "all clear" pursuant to § 2 paragraph 5, the emergency contact receives a corresponding stand-down SMS.

(5) The emergency contact themselves has the right to terminate their role at any time. To do so, they may contact the User, who must remove them from the App without undue delay. In addition, FrontByte reserves the right to remove an emergency contact from the system upon direct request of the affected person, provided that an unauthorized registration or revocation of consent is credibly demonstrated.

(6) FrontByte is not obliged to verify the consent of the emergency contact prior to sending the confirmation request pursuant to paragraph 3. Data protection responsibility for transmitting an emergency contact's phone number to FrontByte lies with the User. The User indemnifies FrontByte against any third-party claims arising from unauthorized registration as an emergency contact.

(7) The User is obliged to regularly review and, where necessary, update their list of emergency contacts, in particular in the case of:

a) a change of a contact's phone number; b) loss of reachability or willingness of a contact (e.g. relocation, illness, change of relationship); c) travel to other time zones in which certain contacts may be more difficult to reach.

(8) FrontByte does not guarantee that emergency contacts in the event of an alert:

a) will receive or read the SMS in good time; b) will actually respond or organize help; c) will access the detail page with the location or alert rescue services.

The responsibility for selecting suitable, reliable and reachable emergency contacts lies exclusively with the User.

(9) Outside of an alert event, emergency contacts do not receive any location information or other data of the User. There is no live tracking, no continuous location transmission and no monitoring.


§ 7 Subscription, Pricing and Payment

(1) SafePing is offered pursuant to § 2 paragraph 1 in two access modes: "SafePing Free" (free of charge, only displaying worldwide emergency numbers) and "SafePing Pro" (paid, with Check-In monitoring, Pre-Alert, alerting of emergency contacts and SOS function). Switching between the two modes occurs automatically based on the subscription status. If the subscription lapses (e.g. after expiry of the trial without subscription, after cancellation or in the event of permanent payment default), the Account is downgraded to Free Mode; the Account itself and the stored data remain intact.

(2) SafePing Pro is offered as a subscription with monthly or annual term. FrontByte reserves the right to expand the pricing model in the future (e.g. with additional tariff tiers or billing periods). The applicable prices, terms and available tariffs – including any time-limited introductory or promotional prices – are transparently displayed to the User in the App and in the respective App Store before entering into the subscription.

(3) FrontByte may offer a one-time free trial period ("Trial") prior to the first paid subscription. The duration and availability of the Trial are configured platform-side and transparently displayed to the User before commencement. During the Trial, all functions of SafePing Pro are available. If the subscription is not cancelled via the respective App Store at least 24 hours before the end of the Trial, it automatically transitions into the chosen paid monthly or annual subscription.

(4) The subscription automatically renews for the respective chosen term (one month or one year), unless cancelled via the App Store at least 24 hours before the end of the current period. These renewal and cancellation modalities follow the requirements of Apple and Google and lie outside FrontByte's sphere of influence. A cancellation takes effect at the end of the current billing period; until then, Pro functions remain active.

(5) Payment processing is conducted exclusively via the Apple App Store (iOS) or the Google Play Store (Android). Verification of subscription status is carried out server-side via the third-party provider RevenueCat. FrontByte has no influence over the choice of payment methods, billing, storage of payment data or refund processing. The terms of use and privacy policies of the respective App Stores and of RevenueCat apply additionally.

(6) In the event of a failed payment collection or chargeback by the App Store, the respective platform-side recovery mechanisms ("Billing Grace Period" or "Account Hold") shall apply first. During an active grace period, the SafePing Pro protection service remains available unchanged, as the subscription is still considered valid from the platform's perspective. Upon entering the Account Hold phase or in the event of permanent payment default, the Account is automatically downgraded to Free Mode; the Pro functions are blocked. Upon successful late payment or conclusion of a new subscription, the Pro functions are automatically reactivated. The Account itself, as well as emergency contacts previously created and confirmed in the Pro phase, are retained in any case and become available again immediately upon resubscription. The exact deadlines and mechanisms are governed by the prevailing provisions of the Apple App Store and the Google Play Store.

(7) Refunds for billing periods already paid are generally excluded, unless mandatory statutory provisions (in particular the right of withdrawal pursuant to § 8) provide otherwise. Since payment processing is conducted via Apple or Google, any refund requests must be submitted directly to the respective App Store; their guidelines are decisive. FrontByte itself cannot issue refunds.

(8) Cancellation of the subscription does not automatically result in deletion of the SafePing Account. The User can delete their Account at any time directly in the App; in this case, all stored data will be removed in accordance with the Privacy Policy. Cancellation of the subscription and deletion of the Account are separate processes.

(9) FrontByte reserves the right to adjust prices and the scope of services of the subscription in the future. Price changes or material changes to the scope of services will be communicated to the User in text form (e.g. via email or in-app notification) at least thirty (30) days before they take effect. The change is deemed accepted unless the User cancels the subscription via the App Store within that period; this consequence will be expressly noted in the communication. Introductory or promotional prices are limited in time or quantity and transition to the regular tariff after their expiry; this will likewise be announced to the User in good time.

(10) Promotions, discounts or time-limited special offers may be offered by FrontByte. They apply exclusively under the conditions stated in the respective promotion and create no entitlement to extension, repetition or extension to other Users.

(11) The User is aware of and expressly accepts that, upon lapse of the active subscription – in particular due to cancellation, payment default, expired payment method or entry into an Account Hold phase – the protection functions of SafePing Pro (Check-In monitoring, Pre-Alert, alerting of emergency contacts, SOS function) are no longer available. The display of worldwide emergency numbers in Free Mode remains unaffected. The User is obliged to check the validity of and update their payment method in good time, in particular before commencing a trip or activity for which they wish to rely on SafePing Pro. In acute emergencies, regardless of the App's status, the official emergency number of the country of stay must always be dialed immediately (cf. § 12).


§ 8 Right of Withdrawal for Consumers in the European Union

(1) Consumers domiciled in the European Union are entitled to a statutory right of withdrawal in accordance with Directive 2011/83/EU (Consumer Rights Directive) and the respective national implementations. A consumer within the meaning of this paragraph is any natural person who concludes the subscription for purposes that are predominantly outside their trade, business or profession.

(2) For Users domiciled in Switzerland or outside the European Union, no statutory right of withdrawal exists; the following provisions do not apply to such Users.

Withdrawal Instructions

(3) Right of withdrawal. You have the right to withdraw from this contract within fourteen (14) days without giving any reason. The withdrawal period expires fourteen days from the day of conclusion of the contract, i.e. from the day on which the paid subscription was concluded via the Apple App Store or Google Play Store.

(4) Immediate commencement of service and effect on the right of withdrawal. By successfully concluding a SafePing Pro subscription and the immediate activation of the protection functions associated therewith, you expressly consent to the provision of the digital service beginning immediately and before the end of the withdrawal period. You acknowledge that your right of withdrawal lapses to the extent that the digital service has already been provided by FrontByte. For parts of the service not yet provided – in particular periods of the paid subscription not yet elapsed – the right of withdrawal continues to exist within the framework of statutory provisions.

(5) Exercise of the right of withdrawal. Since payment processing is conducted via the Apple App Store or Google Play Store, the primary and fastest way to exercise the right of withdrawal is to request a refund directly via the respective App Store:

  • Apple App Store: via reportaproblem.apple.com or directly from the App Store app;
  • Google Play Store: via play.google.com/store/account/orderhistory or directly from the Play Store app.

Apple and Google generally process the refund directly, taking into account the provisions applicable to EU consumers.

(6) Alternatively, you may declare the withdrawal directly to FrontByte – by means of an unambiguous statement (e.g. a letter sent by email). For this you may use the model withdrawal form contained in paragraph 9, although its use is not mandatory. Address the withdrawal to:

To meet the withdrawal deadline, it is sufficient that you send the notification of exercising the right of withdrawal before the end of the withdrawal period. As the payment was processed via Apple or Google, FrontByte will forward a withdrawal declared directly to FrontByte to the respective App Store; a direct refund by FrontByte is technically not possible.

(7) Consequences of withdrawal. In the event of an effective withdrawal, the mutually received services must be returned, insofar as the service has not yet been fully provided. The refund of the amount paid is processed via the Apple App Store or Google Play Store to the payment method originally used by you; in no case will you be charged any fees for this refund.

(8) Trial phase and right of withdrawal. During the free trial period ("Trial" pursuant to § 7 paragraph 3), no costs are incurred by the User and no paid service has yet been rendered. Only with the automatic transition into the paid subscription after expiry of the Trial does the fourteen-day withdrawal period begin to run, unless it lapses pursuant to paragraph 4 upon full provision of services.

(9) Model withdrawal form. If you wish to withdraw from this contract, you may complete and return the following form:

§ 9 Term, Cancellation and Account Deletion

(1) The contract for the use of SafePing Free pursuant to § 3 paragraph 3 is concluded for an indefinite period. It ends through deletion of the Account pursuant to paragraph 5 or through suspension or deletion by FrontByte pursuant to § 3 paragraph 8.

(2) The paid "SafePing Pro" subscription is concluded for the respective chosen term (one month or one year) and renews automatically for the same term pursuant to § 7 paragraph 4 unless cancelled in good time.

(3) Ordinary cancellation of the subscription. The User may ordinarily cancel their subscription at any time. Cancellation takes place exclusively via the subscription management of the respective App Store:

a) iOS: Settings → Apple ID → Subscriptions → SafePing → "Cancel Subscription"; b) Android: Google Play Store → Profile → Payments and Subscriptions → Subscriptions → SafePing → "Cancel Subscription".

The cancellation takes effect at the end of the current billing period. Until then, the Pro functions remain available; afterwards, the Account is downgraded to Free Mode (cf. § 7 paragraph 1).

(4) Extraordinary cancellation. Both parties are entitled to terminate the contractual relationship for cause without notice. Cause exists for FrontByte in particular if:

a) the User materially or repeatedly breaches essential provisions of these Terms; b) the User uses the Service for unlawful or abusive purposes (cf. § 5 paragraph 2 lit. h); c) the User registers third parties as emergency contacts without authorization, thereby violating the rights or legitimate interests of those persons; d) FrontByte permanently discontinues the Service pursuant to § 10.

Cause exists for the User in particular if FrontByte culpably breaches material obligations under the contract and fails to remedy them within a reasonable period despite warning.

(5) Account deletion by the User. The User can delete their SafePing Account at any time and without giving reasons directly in the App (Settings → Account → Delete Account). Upon Account deletion, all of the User's personal data will be irrevocably removed, unless statutory retention obligations apply. Details on the deleted data categories can be found in the Privacy Policy.

(6) Cancellation of the subscription and deletion of the Account are independent processes:

a) Cancellation of the subscription does not lead to deletion of the Account; the Account continues in Free Mode.

b) Account deletion terminates the contractual relationship as a whole but does not automatically cancel a subscription running with the App Store. The User is obliged to cancel an existing subscription separately pursuant to paragraph 3 before deletion of the Account, in order to avoid further charges to their payment method. FrontByte has no possibility to cancel a subscription on the App Store on behalf of the User.

(7) There is no claim to a pro-rated refund of costs in the event of ordinary cancellation in the middle of a paid period (cf. § 7 paragraph 7). In the event of an extraordinary cancellation by the User for cause attributable to FrontByte, FrontByte will endeavor to provide a reasonable pro-rated refund, insofar as this is technically possible via the App Store.

(8) Consequences of contract termination. Upon termination of the contractual relationship – whether through ordinary cancellation followed by Account deletion, through extraordinary cancellation or through unilateral Account deletion pursuant to § 3 paragraph 8 – the User's right to use the Service ends. Confirmed emergency contacts are not separately informed of the termination; they will simply no longer receive alert SMS.


§ 10 Availability, Maintenance and Third-Party Dependencies

(1) FrontByte endeavors to provide the Service with high availability. However, there is no entitlement to uninterrupted availability or to a specific minimum availability. SafePing is offered without express or implied assurance of any specific service level ("SLA").

(2) Scheduled maintenance. FrontByte is entitled to carry out scheduled maintenance, update or improvement work on the Service. Such work will be carried out, where reasonable, during low-traffic periods. FrontByte will inform the User in good time of any prolonged scheduled interruptions via in-app notification, push notification or email.

(3) Unscheduled disruptions. Unscheduled disruptions may occur, among other things, due to:

a) technical failures of FrontByte's server or network infrastructure;

b) disruptions or failures of data processors and engaged third-party providers, in particular:

  • Apple App Store / Google Play Store (platform operation, subscription validation);
  • RevenueCat (USA, server-side verification of subscription status);
  • seven.io (Germany, SMS dispatch for confirmation requests, alert and stand-down SMS, and OTP codes);
  • Apple Push Notification Service (APNs) and Google Firebase Cloud Messaging (FCM) for push notifications;
  • Hosting provider Hetzner Online GmbH (Germany);

c) disruptions of the mobile or internet connection of the User's end device; d) events of force majeure pursuant to paragraph 5.

Such disruptions do not constitute a defect of the Service insofar as FrontByte is not responsible for them.

(4) Temporary status discrepancies. In the case of temporary technical disruptions – in particular network connection failures at App start, errors in the payment or subscription SDK or delayed synchronization of subscription status with the respective App Store – it may happen that the App temporarily downgrades the User to Free Mode or to an information screen despite an active subscription. In such cases, the correct entitlement is generally automatically detected and Pro status restored on the next App start or once the internet connection is re-established.

(5) Force majeure. FrontByte is not liable for performance disruptions due to force majeure. Force majeure includes all circumstances independent of the will and control of the contracting parties, in particular natural disasters, pandemics, official orders, war, terrorist attacks, cyberattacks (e.g. DDoS, ransomware), large-scale power, telecommunications or internet outages, as well as strikes at third-party providers, which could not be avoided despite reasonable care.

(6) Modification and discontinuation of the Service. FrontByte reserves the right to modify, further develop, restrict or discontinue individual functions of the Service, provided this does not impair the essential purpose of the contract. Material changes will be announced to the User in good time in the App, via email or push notification. The provisions on modification of these Terms remain unaffected.

FrontByte is entitled to discontinue the Service as a whole with thirty (30) days' prior notice. In this case:

a) services already paid for in advance but not yet rendered will be refunded on a pro-rata basis, insofar as this is technically possible via the respective App Store; b) the User will be informed of the upcoming discontinuation in good time; c) all stored personal data will be deleted in accordance with the Privacy Policy.

(7) In the event of failure of individual third-party providers (e.g. seven.io for SMS dispatch), there may be a temporary impairment of individual functions, without this constituting a defect of the overall Service. FrontByte will endeavor in such cases to deploy alternative solutions or providers, insofar as this is technically and economically reasonable.


§ 11 Liability and Limitation of Liability

(1) Principle. FrontByte is liable in accordance with the following provisions for damages incurred by the User from or in connection with the use of the Service. Liability is governed primarily by Swiss law (in particular Art. 41 et seq. and Art. 97 et seq. of the Swiss Code of Obligations); mandatory consumer-protection provisions of the User's country of domicile within the European Union remain unaffected.

(2) Unlimited liability. FrontByte is liable without limitation for:

a) damages arising from injury to life, body or health, based on intentional or negligent breach of duty by FrontByte, its legal representatives or vicarious agents; b) other damages based on intentional or grossly negligent breach of duty by FrontByte, its legal representatives or vicarious agents; c) damages caused by breach of an expressly assumed guarantee; d) claims under mandatory statutory provisions, in particular under the Swiss Product Liability Act or comparable product liability provisions.

(3) Limited liability for ordinary negligence. In the case of ordinary negligence, FrontByte is liable exclusively for breach of essential contractual obligations ("cardinal obligations"). Essential contractual obligations are those whose fulfillment is what makes proper performance of the contract possible in the first place and on whose compliance the User regularly relies. In such cases, liability is limited in amount to the contract-typical, foreseeable damage.

(4) Maximum liability. Insofar as FrontByte's liability is limited under the preceding paragraphs, it is limited in amount – to the extent permitted by law – to the amount the User has paid to FrontByte (or via the respective App Store) for a SafePing Pro subscription in the twelve (12) months preceding the damage-triggering event. For Users who use only SafePing Free, liability is limited – to the extent permitted by law – to the typical, foreseeable damage, but no more than CHF 100. This limitation does not apply in the cases of paragraph 2.

(5) Excluded liability. Otherwise, FrontByte's liability is excluded to the extent permitted by law. In particular, FrontByte is not liable for:

a) lost profits, missed savings, indirect damages, consequential damages or pure financial losses; b) damages resulting from breach of User obligations pursuant to § 5, in particular missing or outdated data, revoked permissions, depleted battery, switched-off device, missing internet or mobile connection, or blockages by security-relevant software on the end device; c) damages resulting from non-performance or poor performance by third parties, in particular by Apple, Google, RevenueCat, seven.io, Hetzner, APNs/FCM or mobile providers, insofar as such third parties are not vicarious agents of FrontByte within the meaning of paragraph 2; d) damages resulting from emergency contacts not receiving, reading, understanding or responding to an alert SMS, or doing so with delay (cf. § 6 paragraph 8); e) damages arising from the use of the Service within SafePing Free Mode, in particular from incorrect, incomplete or outdated displayed emergency numbers (cf. § 2 paragraph 10); f) damages from events of force majeure pursuant to § 10 paragraph 5; g) damages arising from use of the Service as the sole safety measure (cf. § 5 paragraph 4).

(6) Safety-relevant character of the Service. The User acknowledges and expressly accepts that SafePing is a technical aid and not a rescue service (cf. § 12). In particular, FrontByte does not guarantee that in an emergency:

a) Check-Ins will be transmitted in good time or completely; b) a Pre-Alert will reach the User in good time; c) an alert SMS will arrive at the emergency contacts, be read or understood; d) emergency contacts will actually organize help or alert rescue services; e) displayed location data will be precise or current.

To the extent it is impossible for FrontByte for reasons outside its sphere of influence to ensure any of these functions, liability is excluded subject to paragraph 2.

(7) Contributory negligence. If the User contributed to a damage through their own fault – in particular through breach of the obligations under § 5 – any liability of FrontByte is reduced or excluded according to the degree of contributory negligence.

(8) Statute of limitations. Claims of the User against FrontByte arising out of or in connection with the contractual relationship are time-barred – to the extent permitted by law – within two (2) years of becoming aware of the damage and the identity of the responsible party. Mandatory longer statutory limitation periods, in particular for intent or personal injury, remain unaffected.

(9) These liability provisions also apply for the benefit of the legal representatives, employees and vicarious agents of FrontByte.


§ 12 No Replacement for Official Emergency Services

(1) SafePing is a technical aid and not a rescue or emergency service. In particular, the Service does not replace direct contact with official emergency numbers such as police, fire department, ambulance services or other governmental or private aid organizations.

(2) In acute emergencies – in particular in cases of imminent danger to life, body, health or property – the official emergency number of the respective country of stay must always be dialed immediately, for example:

a) 112 (uniform European emergency number, also available in many countries worldwide); b) 117 / 118 / 144 (Switzerland: police / fire department / ambulance); c) 110 / 112 (Germany: police / fire department and ambulance); d) 133 / 122 / 144 (Austria: police / fire department / ambulance); e) as well as the respective country-specific emergency numbers, as displayed in SafePing Free Mode.

(3) FrontByte does not establish any connection to rescue or security authorities and does not transmit any emergency information to governmental bodies. Alerting within the meaning of § 2 takes place exclusively to the private emergency contacts registered by the User.

(4) The User is aware of and expressly accepts that:

a) SafePing does not constitute real-time monitoring; b) significant time may elapse between the last transmitted Check-In and the actual notification of emergency contacts (depending on the chosen alert threshold pursuant to § 2 paragraph 3); c) the emergency contacts are private persons and not professional rescue forces; d) even the manually triggered SOS alert pursuant to § 2 paragraph 5 reaches exclusively the registered emergency contacts and does not establish a direct connection to rescue services.

(5) For travel to regions with insufficient mobile or data coverage, in crisis areas or for activities with elevated risk (e.g. alpine tours, dives, expeditions), SafePing is not suitable for use as the sole or primary safety measure. The User must in such cases take supplementary, professional safety precautions (e.g. satellite emergency communication, mountain rescue insurance, travel companions, registration with authorities).

(6) FrontByte assumes no liability for damages based on the User not contacting the official emergency number, contacting it with delay, or relying solely on SafePing in an emergency. The liability limitations of § 11 apply additionally.


§ 13 Data Protection

(1) The protection of the User's personal data is of high priority to FrontByte. The processing of personal data takes place in compliance with the relevant statutory provisions, in particular:

a) the Swiss Federal Act on Data Protection (revFADP); b) the General Data Protection Regulation of the European Union (GDPR) for Users domiciled in the EU; c) supplementary national data protection laws.

(2) The data controller within the meaning of the aforementioned provisions is FrontByte GmbH (cf. § 1 paragraph 1).

(3) Data minimization. SafePing follows the principle of data minimization. Only the data required for operation of the Service is collected and processed:

a) Account data: name, email address, phone number, device token; b) SafePing settings (selected alert threshold, home mode configuration, language, etc.); c) emergency contacts (only with active Pro subscription: name and phone number of persons registered by the User); d) at most the last three (3) transmitted location positions for use in the event of an alert; e) subscription status and payment verification via RevenueCat.

No movement profile and no location history is created. Older data than the last three location positions is automatically and irrevocably deleted.

(4) Data processors. FrontByte uses carefully selected data processors for the operation of the Service. A complete listing – including registered office, processing purpose and transmitted data categories – can be found in the Privacy Policy. Engaged data processors include in particular:

a) Hetzner Online GmbH (Germany) – server hosting; b) RevenueCat, Inc. (USA) – verification of subscription status; c) seven communications GmbH & Co. KG (Willestr. 4-6, 24103 Kiel, Germany) – SMS dispatch; d) Apple Inc. (USA) and Google LLC (USA) – platform operation, push notifications, payment processing.

Corresponding data processing agreements exist with all data processors. Transfers to third countries (in particular the USA) are conducted in compliance with GDPR requirements (Standard Contractual Clauses, adequacy decision etc.), where applicable.

(5) User rights. The User has – to the extent provided by law – in particular the following rights:

a) Right to information about personal data concerning them; b) Right to rectification of inaccurate data; c) Right to erasure ("right to be forgotten"); d) Right to restriction of processing (temporary "freezing" of data, e.g. in case of disputes or doubts about the lawfulness of processing); e) Right to data portability (receipt of one's own data in a structured, machine-readable format for transmission to another provider); f) Right to object to certain processing (in particular against processing for direct marketing or analytics purposes; not, however, against processing necessary for performance of the contract); g) Right to withdraw consents granted, with effect for the future; h) Right to lodge a complaint with the competent supervisory authority (in Switzerland: Federal Data Protection and Information Commissioner FDPIC; in the EU: respective national data protection authority).

(6) Self-service rights in the App. The User can exercise key data protection rights directly in the App:

a) Inspection and editing of Account data in Settings; b) Management and removal of emergency contacts (only in SafePing Pro); c) Complete deletion of the Account including all stored data pursuant to § 9 paragraph 5.

(7) Data protection contact. Inquiries, requests for information and other concerns related to data protection should be directed to:

(8) Disclosure of data to authorities. FrontByte is obliged to disclose personal data to the competent authorities (in particular law enforcement authorities, courts) where a statutory obligation or a legally effective order exists. In acute emergencies with imminent danger to life, FrontByte may also be entitled to forward the last known location data to rescue authorities. FrontByte is expressly not subject to a duty of proactive notification of authorities (cf. § 12 paragraph 3). The User will be informed about any disclosure of data after the fact, to the extent legally permissible.

(9) Further information. Detailed information on the processing of personal data, in particular on processing purposes, legal bases, retention periods, data transfers, and the exercise of the rights pursuant to paragraph 5, can be found in the Privacy Policy at: safeping.net/en/privacy.


§ 14 Intellectual Property and License of Use

(1) Property rights. All rights to the SafePing Service, including the mobile application, the safeping.net website, the associated server software, interfaces, databases, content, designs, layouts, logos, texts, graphics, icons, audio and other components, are the exclusive property of FrontByte or its respective licensors. The Service is protected by copyright, trademark law, design rights and other industrial property rights.

(2) The "SafePing" trademark. The designation "SafePing", the SafePing logo and all other identifiers used by FrontByte in connection with the Service are trademarks or business identifiers of FrontByte. Use of these marks by the User without prior written consent of FrontByte is not permitted.

(3) License granted. FrontByte grants the User, for the duration of the contractual relationship, a simple, non-exclusive, non-transferable, non-sublicensable and revocable right to install the SafePing app on an end device associated with them and to use it for their own non-commercial purposes in accordance with these Terms and applicable statutory provisions.

(4) Use restrictions. The User is expressly prohibited from:

a) copying, reproducing, distributing, making publicly available, renting, lending, selling or otherwise commercially exploiting the App or parts thereof; b) decompiling, disassembling, reverse-engineering or otherwise attempting to obtain the source code of the App, unless this is mandatorily permitted by law (in particular Art. 21 of the Swiss Copyright Act and Art. 6 of EU Software Directive 2009/24/EC for the purposes of interoperability); c) modifying, translating, editing or creating derivative works from the App; d) removing, altering or obscuring copyright, trademark or other intellectual property notices; e) circumventing, manipulating or disabling security, authentication or access mechanisms of the Service; f) using automated systems (bots, crawlers, scrapers) to access the Service or extract data from it, unless expressly permitted by FrontByte; g) using the App in a manner that impairs the security, integrity or availability of the Service or the server infrastructure; h) using the Service on rooted or jailbroken end devices, where this may impair data security or the functionality of the Service.

(5) Third-party licenses. The App contains third-party components subject to their own license terms (in particular open-source libraries). A list of these components, including license information, can be requested from FrontByte support at support@safeping.net. As between User and FrontByte, the provisions of these Terms remain unaffected.

(6) App Store license terms. Use of the App via the Apple App Store is additionally subject to Apple's "Licensed Application End User License Agreement" (EULA); use via the Google Play Store is additionally subject to Google's terms of use. In the event of conflicts between these Terms and the App Store terms, the App Store terms shall prevail to the extent mandatorily required.

(7) User-generated content. Insofar as the User creates or inputs content within the Service (e.g. profile name, emergency contact data, SafePing settings), the User remains the holder of the rights existing in such content. However, the User grants FrontByte the simple, royalty-free right, limited to the duration of the contract, to process, store and transmit such content exclusively for the purpose of performing the contract.

(8) Consequences of breaches. Breaches of the provisions of this paragraph entitle FrontByte to suspend or delete the User's Account pursuant to § 3 paragraph 8 and to terminate the contractual relationship extraordinarily pursuant to § 9 paragraph 4. Claims for damages and injunctive relief are expressly reserved.

(9) Validity after termination of contract. The property rights and use restrictions set out in this paragraph continue to apply after termination of the contractual relationship. Upon termination of the contract, the User is obliged to cease use of the App and to remove all copies of the App from their end devices, insofar as this is technically possible (e.g. by uninstallation).


§ 15 Third Parties and External Services

(1) FrontByte uses various third parties for the provision of the Service, whose services are necessary for the functioning of SafePing. These third parties are not contractual partners of the User. Their respective terms of use and privacy policies apply additionally.

(2) Currently engaged third parties. At the time of entry into force of these Terms, the following third parties are engaged in particular:

a) Apple Inc. (USA) – distribution via Apple App Store, payment processing, push notifications via APNs; b) Google LLC (USA) – distribution via Google Play Store, payment processing, push notifications via FCM; c) RevenueCat, Inc. (USA) – server-side verification of subscription status; d) seven communications GmbH & Co. KG (Germany) – SMS dispatch for confirmation requests, alert and stand-down SMS, and OTP codes; e) Hetzner Online GmbH (Germany) – server hosting of the backend infrastructure; f) The User's mobile and internet service providers – transmission of data between end device and server.

(3) Functional dependencies. The functionality of the Service depends on the availability and proper functioning of the engaged third parties. In the event of outages, disruptions, maintenance work or security incidents at third parties, individual or all functions of the Service may be temporarily restricted or unavailable. § 10 (Availability) and § 11 (Liability) apply additionally.

(4) Data transfers to third parties. As part of the use of the Service, personal data is transmitted to the third parties named in paragraph 2 to the extent necessary for the respective service performance. Details on the type, scope and purpose of the data transmission, as well as on the protective measures taken (in particular for transmissions to third countries such as the USA), can be found in the Privacy Policy.

(5) Change and addition of third parties. FrontByte is entitled to replace engaged third parties with equivalent or better providers or to engage additional third parties, insofar as this is necessary or appropriate for the operation, security or further development of the Service. Material changes, in particular regarding data protection relevance, are updated in the Privacy Policy; in the case of material effects on the User, the User is additionally informed in good time in an appropriate form (e.g. by email or in-app notification).

(6) Own contractual relationships with third parties. Insofar as the User enters into independent contractual relationships with third parties – in particular with Apple or Google via the App Store accounts, with the mobile provider regarding SMS and data transmission, or with the manufacturer of the end device – such relationships exist independently of the contract with FrontByte. FrontByte is not a party to these relationships and assumes no responsibility for any costs, services or disputes resulting therefrom.

(7) No liability for third parties. FrontByte assumes no liability for actions, omissions, failures or breaches of duty by third parties, insofar as they are not vicarious agents of FrontByte within the meaning of § 11 paragraph 2. The liability provisions of § 11 apply additionally.


§ 16 Changes to the Terms of Use

(1) Right to modify. FrontByte reserves the right to amend these Terms at any time with effect for the future, in particular in order to adapt them to changed statutory requirements, technical developments of the Service, new functions, changed third-party relationships or changed economic conditions.

(2) Form and period of notice. Intended changes will be communicated to the User in text form at least thirty (30) days before they enter into force. The communication shall take place at FrontByte's choice via email to the address registered in the Account, by push notification, by in-app notification or by an equivalent form. The communication shall expressly indicate the planned changes, the effective date and the User's right of objection pursuant to paragraph 4.

(3) Deemed consent. If the User does not object to the announced changes within the period pursuant to paragraph 2, the amended Terms shall be deemed accepted. The deemed consent only applies if FrontByte has expressly informed the User in the change communication of this consequence as well as of the right of objection and its period.

(4) Right of objection of the User. The User has the right to object to the announced changes within the period pursuant to paragraph 2. The objection may be declared informally in text form, in particular via email to legal@safeping.net. In the case of a timely objection, the contractual relationship will be continued under the previous terms until the end of the current billing period; FrontByte is then entitled to terminate the contractual relationship ordinarily as of the end of that billing period, insofar as continuation under the previous terms is unreasonable for FrontByte.

(5) Minor changes. Minor changes that are not materially disadvantageous to the User – in particular editorial adjustments, correction of typographical errors, updating of third-party listings or adjustments due to mandatory statutory requirements – may be made without prior notice with effect for the future. Such changes will be published in the respective current version of the Terms at safeping.net/en/terms.

(6) Access to previous versions. The User can call up the respective current version of these Terms at any time at safeping.net/en/terms. Previous versions will be made available on request from FrontByte support at support@safeping.net.

(7) Material changes. In the case of changes affecting material provisions of these Terms – in particular changes to the main performance obligations, the price structure (cf. § 7 paragraph 9), the liability provisions (§ 11) or the data processing (§ 13) – FrontByte may additionally obtain express consent from the User, in particular through a confirmation dialogue at the next App start. Without this consent, access to the changed functions or the contractual relationship as a whole cannot be continued.


§ 17 Final Provisions

(1) Applicable law. These Terms and the entire contractual relationship between FrontByte and the User shall be governed exclusively by Swiss law, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG) and excluding conflict-of-laws rules. Mandatory consumer-protective provisions of the User's country of domicile within the European Union remain unaffected.

(2) Place of jurisdiction. The exclusive place of jurisdiction for all disputes arising out of or in connection with these Terms is Rorschach (Canton of St. Gallen, Switzerland). FrontByte is also entitled to sue the User at their general place of jurisdiction. Mandatory statutory places of jurisdiction, in particular for consumers in the European Union, remain unaffected.

(3) EU dispute resolution (Online Dispute Resolution). The European Commission provides a platform for online dispute resolution (ODR platform) at https://ec.europa.eu/consumers/odr. FrontByte is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration body.

(4) Written form and text form. Communications, declarations and expressions of intent within the framework of this contractual relationship require, unless otherwise stipulated in these Terms, text form (e.g. email, in-app notification). A handwritten signed declaration is not required, unless mandatory statutory provisions stipulate otherwise.

(5) Severability clause. Should individual provisions of these Terms be or become wholly or partly invalid, unenforceable or void, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by the valid and enforceable provision that comes closest to the economic purpose of the invalid provision. The same applies to any gaps in these Terms.

(6) Assignment of contract. FrontByte is entitled to assign its rights and obligations under this contractual relationship in whole or in part to a third party, provided this is reasonable and the User's legitimate interests are preserved. FrontByte will inform the User of such assignment in good time. The User shall in such case be entitled to terminate the contractual relationship extraordinarily. Assignment of the User's rights and obligations to a third party requires the prior written consent of FrontByte.

(7) Set-off and right of retention. The User is entitled to set-off or to assert a right of retention only if their counterclaim has been finally established by court or is undisputed by FrontByte.

(8) Language. The German language version of these Terms is the legally binding version. Translations into other languages are provided for informational purposes only. In the event of any discrepancy or interpretation issue, the German version shall prevail (cf. § 1 paragraph 4).

(9) Entire agreement. These Terms – together with the Privacy Policy and the prevailing terms of the engaged third parties – constitute the entire agreement between the User and FrontByte regarding the Service. There are no oral or implied side agreements.

(10) Entry into force. These Terms enter into force on 1 May 2026.
